1. Introduction
These Terms of Service (the “Terms”) govern your access to and use of TradeCraft’s website, web application, products, tools, content, and related services available at https://hiretradecraft.com and related domains (collectively, the “Service”).
The Service is operated by Tradecraft Recruiting Inc. (“TradeCraft,” “Company,” “we,” “us,” or “our”). “You” or “User” means the individual or entity accessing or using the Service.
By accessing or using the Service, creating an account, clicking to accept these Terms, or purchasing a subscription, you agree to be bound by these Terms and our Privacy Policy. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization, and “you” includes that organization.
If you do not agree to these Terms, do not access or use the Service.
2. The Service
TradeCraft is an AI-assisted profile, resume, and recruiting platform for Canadian skilled trades workers and the employers, recruiters, schools, and organizations that interact with them.
The Service may allow workers to:
- create and manage structured trade profiles;
- upload resumes and use resume import tools;
- use AI-assisted profile, resume, skill, and certification suggestions;
- generate trade-focused resumes;
- choose whether to make a limited recruiter-visible profile available;
- participate in job-agent or matching features;
- enroll in school, training, cohort, or assessment experiences where available.
The Service may allow recruiters, employers, and organizations to:
- create recruiter or organization accounts;
- search limited recruiter-visible worker profiles;
- save searches, favorites, shortlists, candidate pipelines, and notes;
- initiate platform-mediated contact with workers;
- manage recruiting workflows and collaboration.
The Service may also include school/cohort tools, assessments, job-agent features, source-intelligence tools, payment/subscription features, analytics, notifications, and administrative functionality.
3. Eligibility and Accounts
You must be at least 18 years old or the age of majority in your jurisdiction, whichever is higher, to use the Service unless TradeCraft expressly supports a school, apprenticeship, guardian-authorized, or other authorized program for younger users.
When you create an account, you must provide accurate, complete, and current information. You are responsible for maintaining the confidentiality and security of your login credentials and for all activity under your account.
You must notify us promptly at support@hiretradecraft.com if you suspect unauthorized access to or use of your account.
We may refuse registration, suspend, restrict, or terminate accounts where we reasonably believe there is a violation of these Terms, a security risk, unlawful conduct, misuse of the Service, non-payment, or other risk to TradeCraft, users, or third parties.
4. User Roles
The Service may support different user roles, including:
- Workers: individuals who create profiles, upload resumes, use AI tools, participate in job matching, enroll in cohorts, or take assessments.
- Recruiters / Employers: individuals or organizations that search for visible workers, manage recruiting workflows, create notes, and initiate contact.
- Schools / Training Organizations: organizations that manage programs, cohorts, invite codes, enrollments, assessments, or related student/worker workflows.
- Administrators: TradeCraft personnel or authorized users who operate, support, moderate, secure, or administer the Service.
You may only use features for which you are authorized. You must not misrepresent your identity, role, affiliation, authority, credentials, or organization.
5. Worker Profiles and Visibility
Workers may create a full worker profile in TradeCraft. A worker’s full profile is not automatically public.
If a worker chooses to make their profile visible and meets applicable product requirements, TradeCraft may create and display a limited recruiter-visible profile for recruiting and workforce-discovery purposes. This recruiter-visible profile may include selected information such as name or display name, trade, skills, location, experience, selected credentials, availability, compensation or job preferences, school/cohort context, assessment summaries, and other fields shown in the Service.
Workers are responsible for reviewing their profile and visibility settings before making a profile visible. TradeCraft may change profile visibility features or recruiter-visible fields over time and will handle personal information as described in the Privacy Policy.
Recruiters and employers may only use worker profile information for lawful recruiting and workforce-discovery purposes and in accordance with these Terms.
6. Worker Responsibilities
If you are a worker, you represent and agree that:
- information you provide in your profile, resume, certifications, licenses, work history, references, and related materials is accurate, current, and not misleading;
- you have the right to upload and use any resume, document, image, text, or other content you provide;
- you have authority or a lawful basis to provide information about third parties, such as references or emergency contacts;
- you will not falsely claim trade credentials, licenses, certifications, Red Seal status, immigration/work authorization, work history, education, or experience;
- you will review AI-generated or resume-derived suggestions before accepting, publishing, submitting, or relying on them;
- you are responsible for decisions about profile visibility and the information you choose to make available to recruiters.
Unless TradeCraft expressly states otherwise, TradeCraft does not independently verify worker licenses, certifications, trade credentials, Red Seal status, employment history, references, legal work eligibility, or background information.
7. Recruiter and Employer Responsibilities
If you are a recruiter, employer, or organization user, you agree to use the Service only for lawful recruiting, workforce discovery, and related legitimate business purposes.
You must not:
- use worker information for unlawful, discriminatory, harassing, deceptive, or unrelated purposes;
- violate employment, privacy, human-rights, anti-discrimination, anti-spam, communications, or similar laws;
- scrape, harvest, bulk export, resell, broker, republish, or build external databases from worker data or Service content;
- bypass platform-mediated contact controls or contact workers outside permitted channels for improper purposes;
- spam workers or send unlawful commercial electronic messages;
- use TradeCraft profiles, AI outputs, assessment summaries, match scores, or job-agent outputs as background checks, consumer reports, credit/criminal-history checks, immigration/eligibility verifications, credential verifications, or sole automated hiring decisions;
- enter sensitive, discriminatory, or unlawful information into notes or workflows, including protected-class assumptions, medical or disability information, immigration speculation, union retaliation content, or unsupported background-check conclusions;
- make employment decisions in a manner that violates applicable law or relies solely on automated outputs from the Service.
You are responsible for your organization’s use of the Service and for ensuring that your users comply with these Terms.
8. Schools, Cohorts, and Assessments
If you use school, cohort, training, invite-code, or assessment features, you represent and agree that:
- you have authority to create, administer, or participate in the applicable school, cohort, or program;
- you will handle student, worker, enrollment, assessment, and cohort information lawfully and only for authorized purposes;
- you will obtain any required consents or authorizations, including guardian, school, or student consents where applicable;
- you will not use assessment results or school/cohort information in a discriminatory, unlawful, or solely automated manner.
Assessment content, attempts, scores, pass/fail results, and summaries may be incomplete or imperfect. Unless expressly stated, assessments are not licensing exams, credential verifications, employment guarantees, or definitive measures of worker competence.
9. AI-Assisted Features
The Service may include AI-assisted features, including resume parsing, profile enhancement, skill or certification suggestions, resume generation, job matching, job recommendations, and related tools.
AI outputs are generated by automated systems and may be inaccurate, incomplete, biased, outdated, or unsuitable. You are responsible for reviewing, editing, and verifying AI-generated content before relying on it, publishing it, submitting it, or using it in a decision.
TradeCraft does not guarantee that AI outputs will improve employment outcomes, profile quality, resume quality, recruiter interest, candidate suitability, or hiring results.
Recruiters, employers, and organizations must not rely on AI outputs, match scores, assessment summaries, or other automated outputs as the sole basis for hiring, screening, eligibility, compensation, promotion, or other employment-related decisions.
10. AI Model Training and Service Improvement
You grant TradeCraft the rights necessary to provide, operate, secure, support, maintain, and improve the Service, including AI-assisted features that you choose to use.
TradeCraft may use aggregated, de-identified, or otherwise privacy-protected information to evaluate, maintain, secure, and improve the Service and AI-assisted features.
TradeCraft will not use identifiable resumes, worker profiles, assessment results, recruiter notes, or private communications to train foundation models or third-party AI models unless TradeCraft clearly discloses that use and obtains any required consent. Third-party AI providers are not permitted to use User Content to train their models except as disclosed in our Privacy Policy or otherwise authorized.
11. User Content
“User Content” means content, information, data, documents, resumes, profile information, notes, messages, images, text, feedback, or other materials that you submit, upload, post, transmit, store, or otherwise make available through the Service.
You retain ownership of your User Content, subject to the rights you grant in these Terms.
You grant TradeCraft a non-exclusive, worldwide, royalty-free license to host, store, reproduce, process, transmit, display, modify, and otherwise use User Content as reasonably necessary to:
- provide, operate, secure, support, and improve the Service;
- display worker profile information according to the worker’s visibility settings;
- process resume imports and generated resumes;
- provide AI-assisted features requested or enabled by the user;
- enable recruiter, employer, school, cohort, assessment, job-agent, payment, support, analytics, security, and administrative workflows;
- comply with applicable law and enforce these Terms.
You represent that you have all rights necessary to provide User Content and grant this license. You must not upload or submit User Content that is unlawful, misleading, discriminatory, infringing, defamatory, harmful, malicious, or otherwise violates these Terms.
We may remove, restrict, or modify User Content if we believe it violates these Terms, creates legal or security risk, or may harm TradeCraft, users, or third parties.
12. TradeCraft Content and Intellectual Property
The Service, including software, designs, interfaces, workflows, models, prompts, documentation, logos, trademarks, text, graphics, icons, templates, content, and other materials provided by TradeCraft or its licensors (“TradeCraft Content”), is owned by TradeCraft or its licensors and is protected by intellectual property and other laws.
Subject to these Terms, TradeCraft grants you a limited, revocable, non-exclusive, non-transferable, non-sublicensable license to access and use the Service for its intended purposes.
Except as expressly permitted by these Terms, you must not:
- copy, modify, distribute, sell, lease, sublicense, or create derivative works of the Service or TradeCraft Content;
- reverse engineer, decompile, disassemble, or attempt to derive source code, except where prohibited by law;
- access the Service to build a competing product or service;
- benchmark or publicly disclose performance information without prior written consent;
- remove proprietary notices;
- frame, mirror, scrape, or otherwise misuse the Service or TradeCraft Content.
13. Prohibited Uses
You may use the Service only for lawful purposes and in accordance with these Terms. You must not:
- violate applicable law or regulation;
- infringe or violate intellectual property, privacy, publicity, contractual, or other rights;
- impersonate any person or entity;
- submit false, misleading, fraudulent, or deceptive information;
- exploit, harm, or attempt to exploit or harm minors;
- transmit spam, junk mail, chain letters, or unlawful solicitations;
- harass, abuse, threaten, defame, discriminate against, or harm another person;
- introduce viruses, malware, or harmful code;
- interfere with or disrupt the Service, servers, networks, or databases;
- attempt unauthorized access to accounts, systems, or data;
- bypass, disable, or circumvent access controls, rate limits, usage limits, security controls, or visibility settings;
- use bots, scrapers, spiders, crawlers, or automated tools without authorization;
- copy, monitor, harvest, bulk export, or use Service data for unauthorized purposes;
- use downloaded or accessed data, worker profiles, recruiter notes, assessment outputs, job matches, or Service content to train, improve, develop, or test any AI model, machine learning system, or competing product;
- use the Service to make unlawful or solely automated employment decisions;
- use the Service in a way that could harm TradeCraft, users, or third parties.
14. Communications, Email, and SMS
TradeCraft may send transactional or service-related communications, including account, security, support, billing, subscription, profile, recruiter-contact, job-agent, assessment, school/cohort, legal, or policy notices.
TradeCraft may send marketing or promotional communications where permitted by law and, where required, with your consent. You may opt out of marketing emails by using the unsubscribe instructions in the message or contacting support@hiretradecraft.com.
If you provide a mobile number and opt in where required, TradeCraft may send SMS/MMS messages for service notifications, account/security purposes, recruiter-contact workflows, job-agent notifications, or marketing messages. Message frequency varies. Message and data rates may apply. Where supported, you may reply STOP to opt out of marketing SMS and HELP for help.
Opting out of marketing messages does not necessarily stop transactional or service-related messages that are necessary to provide the Service or permitted by law.
TradeCraft does not sell, rent, or share personal information collected through an SMS program with unaffiliated or affiliated third parties for those third parties’ independent marketing purposes.
15. Payments, Subscriptions, and Commercial Agreements
Some parts of the Service may require payment. Self-serve subscriptions are governed by these Terms and any checkout, order, plan, or subscription terms presented at purchase.
Enterprise, custom, or negotiated services may be governed by a separately signed master services agreement, order form, data processing agreement, or other commercial agreement (a “Commercial Agreement”). If a Commercial Agreement conflicts with these Terms, the Commercial Agreement controls for that customer to the extent of the conflict.
Unless otherwise stated at checkout or in a Commercial Agreement:
- subscriptions are billed in advance on a monthly or annual basis;
- subscriptions automatically renew unless cancelled before the renewal date;
- fees are non-refundable except as required by law or expressly stated in writing;
- you authorize TradeCraft and its payment processors to charge applicable fees and taxes to your payment method;
- if payment fails, we may suspend or restrict access until payment is completed.
TradeCraft uses third-party payment processors such as Stripe. TradeCraft does not intend to store full payment card numbers. Payment processing is subject to the payment processor’s terms and privacy policy.
All amounts are in Canadian dollars unless otherwise stated.
16. Third-Party Services and Links
The Service may integrate with, link to, or rely on third-party services, including authentication, hosting, storage, analytics, payments, AI, document parsing, communications, security, and job-source providers.
Third-party services are not controlled by TradeCraft. TradeCraft is not responsible for third-party websites, services, content, policies, or practices. You should review the applicable third-party terms and privacy policies.
17. Privacy
Our Privacy Policy explains how we collect, use, disclose, retain, and protect personal information. By using the Service, you acknowledge that personal information will be handled as described in the Privacy Policy.
If you wish to request access, correction, deletion, account closure, or other privacy-related assistance, contact privacy@hiretradecraft.com. Some records may be retained where permitted or required for legal, security, fraud prevention, billing, audit, dispute-resolution, or enforcement purposes.
18. Analytics, Monitoring, and Security
We may monitor and analyze use of the Service for analytics, diagnostics, security, performance, support, abuse prevention, and product-improvement purposes. We may use third-party providers for these purposes as described in the Privacy Policy.
You must not interfere with security, monitoring, logging, or abuse-prevention systems.
19. Feedback
If you provide ideas, suggestions, bug reports, recommendations, or other feedback about the Service (“Feedback”), you grant TradeCraft a perpetual, irrevocable, worldwide, royalty-free right to use, modify, commercialize, and incorporate the Feedback without restriction or compensation to you. Feedback should not include confidential information unless we have separately agreed in writing.
20. Disclaimers
THE SERVICE IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, TRADECRAFT DISCLAIMS ALL WARRANTIES, EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
TradeCraft does not warrant that the Service will be uninterrupted, error-free, secure, accurate, complete, or available at all times.
TradeCraft does not guarantee:
- jobs, interviews, offers, candidates, workers, hires, placements, revenue, or business outcomes;
- worker availability, suitability, credentials, licensing, work authorization, background, or employment history;
- recruiter, employer, school, or worker conduct;
- accuracy or completeness of worker profiles, resumes, AI outputs, assessment results, match scores, job recommendations, or source information;
- that any AI-assisted output is correct, unbiased, lawful for a particular use, or appropriate for employment decisions.
The Service does not provide legal, employment, immigration, credentialing, financial, or professional advice. You are responsible for your own decisions and for complying with applicable law.
21. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY LAW, TRADECRAFT AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, LICENSORS, SERVICE PROVIDERS, AND SUPPLIERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, BUSINESS, GOODWILL, DATA, OR USE, ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE FULLEST EXTENT PERMITTED BY LAW, TRADECRAFT’S TOTAL LIABILITY ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF: (A) THE AMOUNTS YOU PAID TO TRADECRAFT FOR THE SERVICE IN THE THREE MONTHS BEFORE THE EVENT GIVING RISE TO LIABILITY; OR (B) CAD $100.
Some jurisdictions do not allow certain exclusions or limitations of liability. In those jurisdictions, liability is limited to the fullest extent permitted by law.
22. Indemnification
You agree to defend, indemnify, and hold harmless TradeCraft and its affiliates, officers, directors, employees, agents, licensors, service providers, and suppliers from and against claims, liabilities, damages, losses, and expenses, including reasonable legal fees, arising out of or relating to:
- your access to or use of the Service;
- your User Content;
- your violation of these Terms;
- your violation of applicable law;
- your violation of another person’s rights;
- recruiter, employer, organization, school, or administrator misuse of worker, candidate, student, or assessment information;
- employment, recruiting, communications, anti-spam, human-rights, privacy, or discrimination claims arising from your conduct.
TradeCraft may assume exclusive defense and control of any matter subject to indemnification, and you agree to cooperate with our defense.
23. Suspension and Termination
We may suspend, restrict, or terminate your access to the Service at any time if we reasonably believe:
- you violated these Terms;
- your account creates security, legal, fraud, abuse, or operational risk;
- your use of the Service may harm TradeCraft, users, or third parties;
- payment is overdue;
- we are required to do so by law;
- continued access is inappropriate for any other legitimate reason.
You may stop using the Service at any time. You may request account closure by contacting support@hiretradecraft.com. Privacy-related deletion or access requests may be submitted to privacy@hiretradecraft.com and will be handled under the Privacy Policy and applicable law.
Sections that by their nature should survive termination will survive, including ownership, User Content licenses needed for retained records, payment obligations, disclaimers, limitations of liability, indemnity, dispute resolution, and enforcement provisions.
24. Changes to the Service
We may modify, suspend, discontinue, or restrict access to all or part of the Service at any time. We are not liable for any modification, suspension, discontinuation, or unavailability of the Service, except where prohibited by law or expressly stated in a Commercial Agreement.
25. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will provide notice as required by law, such as by posting the updated Terms, updating the effective date, sending an email, or displaying a notice in the Service.
Your continued use of the Service after updated Terms become effective means you accept the updated Terms. If you do not agree, you must stop using the Service.
Fee changes are handled as described in the applicable subscription, checkout, plan, order, or Commercial Agreement terms.
26. Sanctions and Export Compliance
You represent that you are not located in, organized under the laws of, or ordinarily resident in any country or territory subject to applicable Canadian, US, or other sanctions that prohibit use of the Service, and that you are not listed on any applicable sanctions or restricted-party list.
You agree not to use the Service in violation of Canadian, US, or other applicable export-control or sanctions laws.
27. Governing Law and Dispute Resolution
These Terms are governed by the laws of British Columbia and the federal laws of Canada applicable therein, without regard to conflict-of-law rules.
The parties will first attempt to resolve disputes through good-faith negotiations. If a dispute cannot be resolved informally, the parties submit to the exclusive jurisdiction of the courts located in British Columbia, Canada, except where applicable law requires otherwise.
28. Assignment
You may not assign or transfer these Terms without TradeCraft’s prior written consent. TradeCraft may assign these Terms in connection with a merger, acquisition, financing, reorganization, sale of assets, corporate transaction, or transfer to an affiliate. Any attempted assignment in violation of this section is void.
29. Force Majeure
Neither party is responsible for failure or delay in performance to the extent caused by events beyond reasonable control, including acts of God, natural disasters, war, terrorism, civil unrest, labor disputes, epidemics, failures of utilities, internet or hosting providers, cyberattacks, government actions, or other events beyond reasonable control.
30. Severability and Waiver
If any provision of these Terms is found invalid, illegal, or unenforceable, that provision will be enforced to the maximum extent permitted and the remaining provisions will remain in effect.
Failure to enforce any provision is not a waiver of the right to enforce it later.
31. Entire Agreement
These Terms, the Privacy Policy, any applicable checkout/order/subscription terms, and any applicable Commercial Agreement form the agreement between you and TradeCraft regarding the Service. If a signed Commercial Agreement conflicts with these Terms, the Commercial Agreement controls for that customer to the extent of the conflict.
